Policies

We are very flexible and understanding. However, we do have some rules that we have to enforce in order to keep everything working well.  Our rules typically do not scared great tenants. They actually give them a sense of clarity and understanding on how things are run and what is expected of them. 

If you follow our simple rules, you shouldn’t be concern. Again, these rules exist so everything works smothly.  

POLICIES AND PROCEDURES

1-Alterrations

The TENANT(s) agrees to not alter the property in any way without written approval of the HOMESOME, LLC first, or remove any items that belong to the property.  Any approved alterations, additions, or improvements shall become property of Homesome, LLC and shall remain on the premises at the termination of the tenancy.  

2-Term of the lease

 HOMESOME, LLC leases to the TENANT(s) the premises for the term of month-to-month commencing on the 1st day of  the monthThe lease can be terminated by the tenant by giving 45 days written notice prior to the desired month of termination or by Homesome LLC by giving 15 days written notice.

3-Occupancy:

Only the individuals listed on the lease can occupy the premises unless written consent by HOMESOME, LLC is obtained.  A reasonable number of guests may occupy the premises without prior written consent. Guests’ stay is limited to 72 hours.  There will be an additional rental charge of $100.00 per month for each additional person and only after prior approval from HOMESOME, LLC is obtained in writing.  

4-Rent

TENANT(S) agree(s) to pay the monthly rent amount established on the lease each month in advance without demand from HOMESOME, LLC.  The rent will need to be paid through the means explained in the lease (see more here).  

5-Pet

The TENANT(s) understands and agrees that 0 pets are permitted on the premises without the authorization of Homesome, LLC. There will be a  $250 unrefundable service charge per pet.  Authorization from Homesome LLC cannot be verbal. It has to be in writing. If a pet is brought into the property without written permission from Homesome, LLC, tenant will be asked to remove the pet from the property and pay the 250 non-refundable pet service fee.  

6-Pet rent

If Homesome LLC gives written consent that a pet is allowed in the property, there will be a $25 pet rent per pet per month.  Failure to report a pet will cause termination of the lease.

Late fee

First time late fee is $55.00 and it shall be due as additional rent if TENANT fails to make rent payment by or before the 3rd of the month. In addition to the $55 late fee, starting on the 4th another $10 dollars will be due for each additional day the rent is passed due.

 Second time late fee is $105.00  and it shall be due as additional rent if TENANT fails to make rent payments by or before the 3rd of the month. In addition to the $105 late fee, starting on the 4th another $10 dollars will be due for each additional day the rent is passed due.

Third time late fee is $155.00 and it shall be due as additional rent if TENANT fails to make rent payments by or before the 3rd of the month. In addition to the $155 late fee, starting on the 4th another $10 dollars will be due for each additional day the rent is passed due. If the rent is late 3 times during a 12 months period, Homesome, LLC has the option to terminate the lease with a 15 day notice to vacate the property.

Late payment agreement: If the rent is going to be late,  a date must be communicated of when the late fees and rent will be paid before the rent is late (which must be agreed by Homesome, LLC). 

8-Insuficient funds

If TENANT(s) online rent payment is returned because of insufficient bank account funds, there will be a service charge to the tenant for $50.00. In addition,  tenant will be responsible for all the applicable late fees. (see Late Fee item #7)

9-Application of payment

All payments made shall first be applied to any outstanding balances of any kind including late charges or any other charges before it’s applied to the rent, which shall be deemed as rent due under this lease. All notices by TENANT(s) to HOMESOME, LLC shall be sent to Homesome LLC 7901 4th St. N Suite 300 Petersburg, FL 33702 by certified mail. 

10-Security deposit

 All deposits will be refunded within 30 days of vacating the property, returning the keys to the HOMESOME, LLC staff and the termination of this contract according to other terms herein agreed.  At that time, HOMESOME, LLC will inspect the premises thoroughly and assess any damages and/or needed repairs.  The deposit money minus any necessary charges for missing items, repairs, cleaning, etc. will then be returned to the Tenant with a written explanation of deductions within 30 days after they have vacated the property.  No interest will be paid on this money and in no case will it be applied to future rent.  Deposit is never returned on the same day of vacating the property. Expedited return of deposit can be arranged for a fee. Expedited return of deposit takes up to 3 days.

11-Changes in terms of tenancy

 HOMESOME, LLC shall advise TENANT(s) of any changes in terms of tenancy with advance notice of at least (15) days.  Changes may include notices of termination, rent adjustments, or other reasonable changes in the terms of this Agreement.  TENANT will notify HOMESOME, LLC with written notice of voluntarily vacating property with advance notice of at least (45) days. 

12-Risk of loss

All TENANT(s) personal property shall be at the risk of the TENANT(s) or owner thereof and HOMESOME, LLC shall not be liable for any damage to said personal property of the TENANT(s) arising from criminal acts, fire, storm, flood, rain, or wind damage, act of negligence of any person whomever, or from the bursting or leaking of water pipers.  TENANT(s) is strongly advised to secure insurance for personal property. 

13-Utilities

 HOMESOME, LLC does not provide any utility. The TENANT(s) agree(s) to pay all charges and deposits for all utilities and TENANT(s) agree(s) to have all accounts for utilities immediately placed in TENANT(s) name with accounts kept current throughout occupancy.  If the utilities, which TENANT(s) is (are) responsible for are still in HOMESOME, LLC(s) name at the time TENANT(s) take(s) occupancy, TENANT(s) agree(s) to notify HOMESOME, LLC(s) and shall order such utilities to be terminated.  Utilities mean water, sewer, trash/garbage, electric, cable TV, phone, etc.

14-Default

(1)Failure of TENANT(s) to pay rent or any additional rent when due, or (2) TENANT(s) violation of any other term, condition or covenant of this lease (and if applicable, attached rules and regulations), condominium by laws or neighborhood deed restrictions or (3) failure of TENANT(s) to comply with Federal, State, and or County laws, rules, ordinances or (4) TENANT(s) failure to move into premises or TENANT(s) abandonment of the premises, shall constitute a default by TENANT(s).  Upon default, in addition to complete forfeiture of the security deposit, rent due for the remaining term of this lease is accelerated.  TENANT(s) shall owe this rent.

15-Vehicles

 Vehicle(s) must be currently licensed, owned by TENANT(s), registered, operational and properly parked.  TENANT(s) agree(s) to abide by all parking rules established now or in the future by Homesome LLC.  No trailers, campers, vehicles on blocks, motorcycles, boats, or other commercial vehicles are allowed on or about the premises without Homesome LLC prior written approval.  TENANT(s) are not to repair or disassemble vehicles on the premises.  Vehicles not meeting the above requirements and additional rules of Homesome LLC are unauthorized vehicles and are subject to towing at TENANT(s) expense.  Parking on the grass is prohibited and can lead to possible termination of the lease.  Only cars declared during the application process can be parked on the property.

16-Keep cars on driveway

 If cars are parked on the grass, $100 fee will be charged per day the car is on the grass.

17-Attorney fees

 If HOMESOME, LLC employs an attorney due to TENANT(s) violation of the terms and conditions of this lease, TENANT(s) shall be responsible for attorney’s fees as incurred by the HOMESOME, LLC whether or not suit is filed.  TENANT waives the right to demand a jury trial concerning any litigation between HOMESOME, LLC and tenant.

18-Vacating

 At the expiration of this agreement or any extension, TENANT(s) shall peaceably surrender the premises and turn in all keys and any other property owned by HOMESOME, LLC.

19-Abandoned property

By signing the rental agreement, the TENANT(s) agrees that upon surrender or abandonment, as defined by the Florida Statutes, HOMESOME, LLC shall not be liable or responsible for storage or disposition of TENANT(s) personal property. 

20-Expiration and renewal

 TENANT(s) must give written notice not less than 45 days  before vacating the property. If something needs to be changed in the lease, the tenant will be notified in writing. This lease can only be terminated by TENANT(s) by giving 45 days written notice or HOMESOME, LLC by giving 15 days written notice. All other conditions of this lease shall remain in effect.  Failure to give above stated notice by TENANT(s) will result in extra rent charges.

21-Indemnification

 TENANT(s) agree to reimburse HOMESOME, LLC upon demand in the amount of the loss property damage or cause of repairs or service (including plumbing trouble) caused by the negligence or improper use by TENANT(s), family or guests.  TENANT(s) at all time will indemnify and hold harmless HOMESOME, LLC  for any injuries or damages to the person or property of any person(s), caused by the acts, omissions, neglect or fault of TENANT(s), his/her family or guests or arising from TENANT(s) failure to comply with any applicable laws, statutes, ordinances, or regulations. 

22-Repairs

 The tenant agrees to maintain and fix any minor issue with this property that doesn’t exceed $35. This means that the first $35 of every repair will be the responsibility of tenant. Example of possible things tenants will be responsible for fixing (doorknobs, resetting electric breakers, light bulbs, blinds, plugged drains, jammed garbage disposal, clogged toilets, ceiling fan repairs, smoke alarm, and smoke alarm’s batteries, A/C filters, jammed windows, jammed doors, leaky faucet, closet doors falling of the tracks, sliding doors oiling, etc.) In addition, if the bathroom or kitchen drains are clogged due to tenants’ doing (i.e. paper towels, feminine products, baby wipes, and any other items other than toilet paper, tenant will be 100% responsible for entire repair bill which can be anywhere between $300-$500. In addition, tenant should also avoid putting food down the kitchen drain even if a garbage disposal is present for that too can cause problems.

23-Access to premises

 Homesome LLC reserves the right to enter the residence at reasonable times to inspect, make necessary repairs, supply services, or show it to prospective residents, purchasers, workmen, or contractors.  Whenever practicable, one day notice of a staff intent to enter shall be given to the Resident.  A text message counts as a written notice.

24-Radon gas

Radon Gas is a naturally occurring radioactive gas that, when it is accumulated in a building in sufficient quantities, may present health risks to persons who are exposed to it overtime.  Levels of radon that exceed federal and state guidelines have been found in buildings in Florida.  Additional information regarding radon and radon testing may be obtained from your county public health unit. 

25-No subletting is allowed.

Tenant is not allowed to rent rooms or rent portion or the whole house to other people. If this happens, the lease will be terminated immediately.

26-No smoking

Smoking is not permitted inside the premises by tenants, guests, or invitees.

27-Lawn and bushes

 Tenant will be responsible for the grass, bushes, and trees on the property. This mean cutting grass, keeping bushes/trees trimmed, & weeds pulled around the bushes, etc.

28-Pest control

Pest control within your unit and around your unit is your responsibility.

29-Hurricane notice

 Tenants are responsible for boarding up the property (windows, doors, and placing sandbags by doors). Covers for the windows and doors already exist on the property and tenants are responsible for keeping those covers in an indoor secured location away from the elements throughout the year. A fee will be accessed if those covers are displaced or left out to the elements throughout the year.

30-Air filter

 Filter for the air conditioner should be changed monthly. Failure to do so can lead to dirt accumulation on the air conditioner’s coils which can cause the air conditioner to stop working properly. If air conditioner stops working or starts malfunctioning because of a dirty filter, tenant will be responsible for the bill to fix the air conditioner, which can be up to $500. Monthly proof of purchase of AC filters will be required from that point on. Also, during our twice a year inspection, if AC filter is found to be unreasonably dirty,  the monthly AC filter proof of purchase will go in effect.

31-Communication notices

Tenant must stay in communication with Homesome, LLC. This means that the tenant must call back or text back Homesome, LLC within 24 hours after a communication from the Homesome, LLC is received. Failure to call back or text back  Homesome, LLC will result in a breach of this lease. If this happens, the lease will not be renewed.

32-Acceptable communication

 A text message is an acceptable way of communication. However, from time to time a conversation over the phone will be requested.  When this happens a text message won’t be acceptable as a communication means.  If tenant refuses to have a conversation through the phone, the lease will be terminated immediately.

33-Correct or vacate

During the duration of the lease Homesome, LLC will conduct drive-by inspections to inspect the exterior of the property or in-house visit with 24 hours notice to inspect the property. If tenant needs to correct something in the property, 7 days verbal or written notice will be given to correct the issue. If the tenant fails to correct the issue in seven days, the lease will not be renewed.

34-Trip fee

 Typically contractors charge a trip fee to come to the property even if no work is performed. If an arranged time is worked out with the tenant for a contractor to come by and do an inspection or do a repair and tenant fails to be present at the property at the agreed time to allow the contractor or inspector in, there will be a trip fee of $100, which will be charged to the tenant. This fee is usually what contractors or inspectors charge for coming to the property even if no work is performed.  In this case, the tenant will be responsible for this fee.

35-No business can be conducted at the property

 Tenant is not allowed to dog sit, baby sit, fix cars as a business, etc in the properties. If this happens, the lease will be terminated immediately.

36-Respect the property

 We’ll conduct inspections on the property twice a year. We measure respect to the property by cleanliness of property inside and outside. If something needs to be corrected, a seven-day notice to correct will be given. If the correction is not made in seven days, you will be given a 15 days’ notice to vacate the property.  

37-Zero tolerance for rudeness

Rude language and disrespect is not tolerated. We are all human and we are allowed to have an off day or be upset, but you are not.  allowed to take your anger on anyone at our company.

38-Locks/Lockouts

 Tenants are not allowed to change the locks on the door of the property. If you get lockouted of the property. There will be a 100 service charge to get someone there to open the door for you.

Letters

If you need a letter from our office for whatever reason, one can be provided for you for a fee. Typically, $25-$50.

Mold/Moisture

There are no established guidelines for unacceptable air quality caused by mold. Mold is a naturally occurring phenomenon. Mold and/ or mildew should be cleaned as soon as it appears. Mold and/or mildew growth can often be seen in the form of discoloration. The different colors of mold range from white to black, including, but not limited to, green, gray, brown, orange, yellow and other colors. Your housekeeping and living habits are an integral part of the ability of mold to grow. In order for mold to grow, water and/or moisture must be present.

RESIDENT AGREES to maintain the Premises in a manner that prevents the occurrence of mold or mildew growth within the Premises. In furtherance of such obligation, RESIDENT AGREES TO PERFORM THE FOLLOWING:

  1. To keep the Premises free from dirt and debris that can harbor mold;
  2. To inspect the Premises regularly for the indications and sources of indoor moisture;
  3. To immediately report to management any discoloration evidenced on walls, floors, or ceiling and/or any water intrusion, such as plumbing leaks, drips or flooding;
  4. To not air dry wet clothes indoors;
  5. To always utilize stove hood vents when cooking items that may cause steam;
  6. When showering/bathing, to always utilize the bathroom fan and to notify management of any nonworking fan;
  7. To water plants outdoors;
  8. To notify management in writing of overflows from bathroom, kitchen or any other water source facilities, especially in cases where the overflow may have permeated walls, flooring or cabinets;
  9. TO IMMEDIATELY WIPE DOWN ANY WATER OR CONDENSATION THAT APPEARS AND/OR DEVELOPS ON ANY AREA OR ANY SURFACE;
  10. To clean upon first appearance, any mildew from condensation on window interiors, bathroom & kitchen walls, floor and/or ceilings. Cleaning is done with common household bleach. Mixture is one part bleach to 10 parts water. You may add a little dish soap to the water mixture to cut any dirt and oil on the surface you are cleaning that may hold mold. Do not add other cleaning chemicals, especially ammonia. Dispose of any rags or sponges used to clean the mold in a sealed bag;
  11. TO REPORT TO MANAGEMENT IN WRITING AND VERBALLY THE PRESENCE OF ANY MOLD GROWTH on surfaces inside the Premises;
  12. To allow management immediate entry to the Premises to inspect and make necessary repairs in the event mold or water intrusion is present;
  13. To use all reasonable care to close all windows and other openings in the Premises to prevent outdoor water from penetrating into the interior unit;
  14. To clean and dry any visible condensation/moisture on windows and window tracks, walls and other surfaces, including personal property as soon as reasonably possible. Condensation on windows indicates that fresh air is not being circulated in the home to prevent moisture buildup. Open your windows and air out your home for short periods of time to keep fresh air present. Excessive running of your heater will cause condensation in you home;
  15. To notify management of any problems with air-conditioning or heating systems that are discovered by Resident;
  16. To maximize the circulation of air by keeping furniture away from walls and out of corners;
  17. In addition to the above, Resident further agrees to perform all responsibilities set forth in the MOLD/MOISTURE DISCLOSURE STATEMENT.
